These Terms & Conditions govern purchases made through milagio.com (the “Website”).
Milagio is the trading name under which Fernando C. operates the Milagio online store.

For the purposes of these Terms & Conditions, “Milagio”, “we”, “us” and “our” refer to the operator of the Milagio online store.
2. PRODUCTS
Milagio offers fine-art prints, framed artwork and related wall-art products.
The products available through the Website are based on standard Milagio designs. The selection of available sizes, formats, frames and other product options may vary by product.
We make reasonable efforts to ensure that product descriptions, images, dimensions, colours and other information displayed on the Website are accurate. However, colours may appear differently depending on the device or screen used to view them, and minor variations may occur as part of the printing, framing or manufacturing process.
Such variations do not affect any statutory rights you may have.
3. PRODUCT AVAILABILITY
All products are subject to availability.
Some Milagio products are produced after an order is placed rather than held as pre-produced inventory.
If, after you place an order, we become unable to fulfil it for any reason, we will inform you as soon as reasonably possible and provide an appropriate refund in accordance with applicable law.
4. PRICES, TAXES AND ADDITIONAL CHARGES
All prices displayed on the Website are stated in euros (€).
The applicable product price and any applicable taxes or delivery charges will be presented before you complete your purchase.
Unless otherwise stated, delivery charges are separate from the product price.
For orders delivered outside the destination country or customs territory in which the order is fulfilled, additional customs duties, import taxes, clearance charges or similar fees may apply. Unless otherwise stated at checkout or required by applicable law, such charges are the responsibility of the customer.
We reserve the right to correct genuine errors in pricing or product information. If an error materially affects an order you have already placed, we will contact you and provide the options available under applicable law.
5. PLACING AN ORDER
Before completing an order, you will have the opportunity to review the products selected, quantities, delivery information and other order details and to correct any errors.
By completing the checkout process and submitting an order, you agree to purchase the selected products at the stated price and subject to these Terms & Conditions.
After submitting your order, you will receive an order confirmation by email.
An order is accepted and a binding contract is formed when we confirm acceptance of your order, subject to any mandatory consumer rights that apply.
If we are unable to accept your order, we will inform you and refund any payment already made.
6. PAYMENT
Payment must be made using one of the payment methods made available at checkout.
Payments may be processed by third-party payment service providers, including Stripe.
Milagio does not store your complete payment card number or security code.
We may be unable to begin production or fulfilment until payment has been successfully authorised.
7. PRODUCTION AND FULFILMENT
Milagio may use specialised third-party production and fulfilment partners to produce and dispatch orders.
These partners may manufacture, package and/or ship products on our behalf in accordance with the order placed through the Website.
The use of third-party production or fulfilment providers does not affect your statutory rights against Milagio as the seller.

8. DELIVERY
Milagio offers worldwide delivery to destinations where our fulfilment network is able to provide service.
Our principal markets include the European Union, United Kingdom, United States, Canada, Australia and New Zealand.
Available delivery destinations, delivery charges and estimated delivery times will be displayed during the purchase process where applicable.
Delivery times are estimates and may vary depending on the destination, product, production time, carrier and other circumstances affecting delivery.
Where tracking is available, tracking information may be provided after the order has been dispatched.
Customers are responsible for providing accurate and complete delivery information. We are not responsible for delays or failed deliveries resulting from incorrect or incomplete information supplied by the customer, except where applicable law provides otherwise.
International deliveries may be subject to customs procedures or other requirements imposed by the destination country.
9. CANCELLATION AND RIGHT OF WITHDRAWAL
Where a statutory right of withdrawal applies, you may cancel your purchase within the applicable withdrawal period without giving a reason.
For consumers in the European Union, the standard withdrawal period for goods purchased online is generally 14 days from the day on which the consumer, or a person designated by the consumer other than the carrier, acquires physical possession of the goods.
If you exercise a statutory right of withdrawal because you have changed your mind, you will generally be responsible for the direct cost of returning the goods to Milagio, provided that we informed you of this responsibility before you placed your order.
You may handle and inspect the product to the extent reasonably necessary to establish its nature, characteristics and functioning. You may be responsible for any reduction in value resulting from handling beyond what is reasonably necessary for that purpose, to the extent permitted by applicable law.

Nothing in these Terms & Conditions limits or excludes any mandatory statutory cancellation, withdrawal, refund or consumer protection rights.
10. PRODUCTS PRODUCED AFTER AN ORDER
Some products offered by Milagio may be produced only after an order has been placed.
The fact that a product is produced after an order is placed does not, by itself, remove any statutory consumer rights.
Where a statutory right of withdrawal, cancellation, return or refund applies, that right remains unaffected by the production method, subject to any legally applicable exception.
11. RETURNS, REFUNDS AND RETURN COSTS
Our Returns, Refunds & Right of Withdrawal Policy forms part of these Terms & Conditions and provides further information about exercising statutory rights, returning products and receiving refunds.
11.1 Change-of-Mind Returns
Where a statutory right of withdrawal applies and you decide to return a product simply because you have changed your mind, you are responsible for the direct cost of returning the product to Milagio, provided that we informed you of this responsibility before you placed your order.
Milagio will not charge a separate return-handling fee unless such a charge is expressly permitted by applicable law.
11.2 Condition and Handling of Returned Products
You may handle and inspect a product to the extent reasonably necessary to establish its nature, characteristics and functioning.
If you handle a product beyond what is reasonably necessary for such inspection and this results in a reduction in the product's value, you may be responsible for that reduction in value to the extent permitted by applicable law.
For example, carefully opening the packaging and inspecting an artwork would not, by itself, normally result in a deduction. However, damage to the frame, staining or marking of the artwork, or other handling beyond reasonable inspection may result in a corresponding reduction of the refund where permitted by law.
Any deduction will be limited to the actual reduction in value attributable to the customer's handling.
11.3 Defective, Damaged or Incorrect Products
The return-cost provisions for change-of-mind returns do not apply where a product is defective, damaged before delivery, incorrect, materially different from the product ordered, or otherwise fails to conform to the contract.
In such circumstances, Milagio will bear the applicable return and replacement costs and provide the remedy required by applicable law.
11.4 Refunds
Where a refund is due, Milagio will process the refund in accordance with applicable law.
Where permitted by applicable law, we may withhold reimbursement until we have received the returned product or until you provide evidence that the product has been sent back, whichever occurs first.
Where a statutory right of withdrawal applies, we will reimburse the payments required by applicable law, including the cost of the least expensive standard delivery option offered.
Additional delivery costs resulting from your choice of a more expensive delivery method will not be reimbursed where permitted by applicable law.
Refunds will normally be made using the same payment method used for the original transaction, unless otherwise agreed or required by applicable law.
12. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS
If you receive a product that is damaged, defective, materially different from the product ordered, or otherwise does not conform to the contract, please contact us at hello@milagio.com as soon as reasonably possible.
Please include your order number and, where appropriate, photographs of the product and its packaging so that we can assess the issue efficiently.
Where a product is defective, damaged, incorrect or otherwise fails to conform to the applicable contractual or statutory requirements, we will provide the remedy required by applicable law.
Depending on the circumstances and applicable law, this may include repair, replacement, price reduction or refund.
You should not dispose of or return a damaged or defective product before contacting us, unless otherwise required by applicable law or instructed by us.
13. LEGAL GUARANTEES AND STATUTORY CONSUMER RIGHTS
Nothing in these Terms & Conditions limits or excludes any mandatory consumer rights or legal guarantees applicable to your purchase.
Consumers are entitled to the statutory guarantees and remedies provided by the laws applicable to their purchase.
For consumers in Spain, new consumer goods are currently subject to a three-year statutory legal guarantee from the date of delivery, subject to the conditions established by applicable law.
Consumers in other jurisdictions may have different statutory guarantee periods or remedies.
Where mandatory consumer protection legislation applies to your purchase, those rights remain fully applicable regardless of anything stated in these Terms & Conditions.
14. INTELLECTUAL PROPERTY
All artwork, designs, images, photographs, logos, trademarks, text, graphics, website content and other intellectual property displayed or made available through the Website are owned by or licensed to Milagio and are protected by applicable intellectual property laws.
The purchase of a physical Milagio product transfers ownership of the physical product to the customer. It does not transfer ownership of the underlying artwork, copyright, design, trademark or other intellectual property.
Unless expressly authorised by Milagio in writing, customers may not reproduce, copy, distribute, publish, modify, commercially exploit or otherwise use Milagio artwork or other protected content beyond ordinary personal use of the purchased product.
15. WEBSITE USE
You may use the Website only for lawful purposes and in accordance with these Terms & Conditions.
You must not:
- use the Website for fraudulent, unlawful or unauthorised purposes;
- interfere with or attempt to compromise the operation or security of the Website;
- attempt to gain unauthorised access to our systems or data;
- introduce malicious software or other harmful material;
- reproduce or commercially exploit Website content without authorisation; or
- use the Website in a manner that could damage Milagio, its systems, its reputation or other users.
16. PRODUCT AND WEBSITE INFORMATION
We make reasonable efforts to ensure that information published on the Website is accurate and current.
However, minor differences may occur between product photographs or digital representations and the physical product, particularly in relation to colour, texture, lighting and screen display.
Such differences do not affect your statutory rights.
We reserve the right to update product information, correct errors and make reasonable changes to the Website.
If a material error affects an order you have already placed, we will contact you and provide the appropriate options available under applicable law.
17. LIABILITY
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation would be unlawful.
In particular, nothing in these Terms & Conditions excludes or limits liability for mandatory consumer rights, statutory guarantees, defective products or other liability that cannot legally be excluded or limited.
Subject to applicable law, Milagio will not be liable for indirect or unforeseeable losses arising from a breach of these Terms & Conditions.
Nothing in this section affects any rights or remedies that cannot legally be excluded or restricted.
18. EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control.
Such circumstances may include natural disasters, severe weather, war, civil unrest, strikes, government restrictions, significant transport disruption, customs delays, failures of telecommunications or infrastructure, or significant disruption affecting our production or fulfilment partners.
Where such circumstances occur, we will take reasonable steps to minimise their impact and resume performance as soon as reasonably practicable.
This section does not affect any mandatory consumer rights.
19. PRIVACY AND COOKIES
We process personal information in accordance with our Privacy Policy.
Information about cookies and similar technologies used on the Website is provided in our Cookie Policy.
By using the Website and placing an order, you acknowledge that your personal information may be processed as described in those policies and in accordance with applicable data protection law.
20. APPLICABLE LAW AND CONSUMER PROTECTION
These Terms & Conditions are governed by the laws applicable to Milagio's establishment in Spain, subject to any mandatory consumer protection provisions that apply to the customer in their country of residence.
If you are a consumer, nothing in these Terms & Conditions prevents you from relying on mandatory rights or protections available to you under applicable law.
Where applicable, consumers may also have access to statutory alternative dispute resolution or other consumer dispute mechanisms available in their jurisdiction.
21. CHANGES TO THESE TERMS
We may update these Terms & Conditions from time to time to reflect changes to our products, services, business practices or legal obligations.
The version applicable to your purchase will normally be the version in force at the time you place your order.
